Part T – Creation and Use of Audio-Visual Recordings

1.1 Students may wish to make audio recordings of meetings or taught sessions for their own reference, albeit many lectures and other taught sessions will be recorded and made available to students via their Virtual Learning Environment (normally Blackboard). Where a recording of taught sessions or meetings is for personal use only, individuals do not need to obtain consent or let other participants know they are making such a recording, however as a matter of courtesy, it isrecommended to make relevant staff members aware, so they can facilitate this if required.  

 

1.2 There are some learning activities which contain highly confidential and sensitive materials, connected to identifiable individuals. In line with our data protection obligations, University staff will indicate when these sessions are to take place and state that recording of those sessions is not permitted, whether for personal use or otherwise. Individuals found to have recorded these sessions may be subject to action under the University’s disciplinary and related regulations. 

 

1.3 Sharing, copying or selling audio or visual recordings could breach the privacy rights of individuals under relevant Data Protection Legislation, intellectual property rules and, in some events, could constitute a criminal offence. Investigation will be considered under the Student Conduct and Disciplinary Regulations where such a breach may have occurred. 

  

1.4 The University will not accept or admit as evidence in any proceedings any recording made without the informed explicit consent of all participants, and any recordings made in contravention of this policy will be without prejudice. Submission of a clandestine recording which is alleged to have breached the personal privacy rights of participants may lead to disciplinary action being initiated against the person who made the recording.  

  

1.5 The University reserves the right to seek advice and act accordingly where any such or related materials are shared with it, particularly which might give rise to concerns about safeguarding or criminal acts.
